COVERAGE BASICS

UNDERSTANDING YOUR COVERAGE

Understand the core product-only coverage concepts before reviewing the complete warranty terms.

WHAT THIS WARRANTY COVERS

Subject to all warranty terms, covered products are warranted against qualifying defects in material or manufacturing and other covered product conditions determined by 123COURTS to be attributable to the covered product itself during the applicable warranty period.

WARRANTY BASE

For covered products purchased directly from 123COURTS, the Warranty Base is the net product purchase price actually paid to 123COURTS for the qualifying affected covered product, after applicable product discounts. Non-product charges are excluded.

AFFECTED PRODUCT ONLY

Coverage applies only to the qualifying affected covered product. A condition affecting one portion of a court or installation does not, by itself, establish that unaffected portions are defective or covered.

REPLACEMENT PRODUCT

If a claim qualifies, 123COURTS may replace all or part of the covered product determined to qualify under this warranty, subject to the applicable Warranty Value.

COMPARABLE REPLACEMENT

If the original product, color, design, component, or configuration is no longer available, 123COURTS may provide a reasonably comparable replacement product.

WARRANTY CREDIT

A Warranty Credit is a non-cash warranty remedy. It has no cash value, is not redeemable for cash, is not a cash refund, and may be applied only toward eligible replacement product as authorized by 123COURTS.

IMPORTANT TO KNOW

IMPORTANT CONDITIONS & EXCLUSIONS

Installation, site conditions, use, maintenance, environmental exposure, and other factors can affect warranty coverage. Review these conditions carefully.

INSTALLATION OVER A SURFACE THAT IS NOT APPROVED BY 123COURTS FOR THE APPLICABLE PRODUCT OR APPLICATION VOIDS THIS LIMITED PRODUCT WARRANTY.

APPROVED INSTALLATION SURFACES

Covered 123COURTS modular sports flooring must be installed only over a surface approved by 123COURTS for the applicable product and application and in accordance with applicable 123COURTS installation requirements. An approved surface must also be properly prepared, stable, level, suitable for the intended application, and maintained appropriately.

INSTALLATION, BASE & SITE CONDITIONS

The customer and/or independent installer is responsible for project dimensions, approved supporting surface, base and subsurface conditions, grade, drainage, clearances, site preparation, installation methods, applicable permits, codes, and project safety requirements.

DRAINAGE, STANDING WATER & SITE MOVEMENT

Damage, movement, deformation, deterioration, or other product conditions caused or contributed to by inadequate drainage, standing water, flooding, erosion, settlement, supporting-surface movement or deterioration, improper grade, or other site-related conditions are not covered.

PRODUCT MODIFICATIONS

Unauthorized cutting, drilling, fastening, alteration, modification, or repair may void coverage for the affected product. Proper field cuts or modifications expressly permitted by applicable 123COURTS installation instructions do not, by themselves, void this warranty.

REFLECTED SUNLIGHT & CONCENTRATED HEAT

Fading, discoloration, warping, deformation, distortion, melting, surface damage, or other deterioration caused or contributed to by reflected or concentrated sunlight, heat, or solar energy is not covered.

COLOR FADING & APPEARANCE CHANGES

Normal changes in color, shade, sheen, or appearance resulting from ordinary aging, use, UV exposure, weather, environmental conditions, cleaning, and maintenance are not, by themselves, considered a product defect. Abnormal or excessive fading may be submitted for warranty review.

REMOVAL, RELOCATION & REINSTALLATION

Damage or other product conditions caused or contributed to by removal, handling, storage, transportation, relocation, or reinstallation are not covered. Any reinstallation must comply with then-applicable 123COURTS installation requirements.

NORMAL WEAR & AGING

Normal wear, abrasion, cosmetic changes, minor appearance variation, and ordinary deterioration resulting from use are not, by themselves, manufacturing defects.

WHAT THIS WARRANTY DOES NOT COVER

  • Improper installation.
  • Installation over any surface not approved by 123COURTS for the applicable product or application.
  • Improper repair or unauthorized product modification.
  • Improper cleaning or maintenance.
  • Failure to follow applicable product or installation requirements.
  • Uneven, unstable, unsuitable, improperly prepared, or deteriorated supporting surfaces, bases, or subsurfaces.
  • Inadequate drainage, standing water, flooding, erosion, settlement, or site movement.
  • Improper site conditions.
  • Abuse, misuse, neglect, vandalism, or intentional damage.
  • Cutting, burning, fire, or similar physical damage except for authorized field modifications performed in accordance with applicable installation requirements.
  • Inappropriate footwear, equipment, vehicles, machinery, loads, or uses.
  • Chemicals, herbicides, pesticides, solvents, corrosive materials, or other harmful substances.
  • Abnormal environmental conditions.
  • Force majeure events or circumstances beyond the reasonable control of 123COURTS.
  • Normal wear, abrasion, scratching, cosmetic deterioration, or aging resulting from ordinary use.
  • Normal or gradual color or appearance changes.
  • Fading, discoloration, warping, deformation, melting, or deterioration caused or contributed to by reflected or concentrated sunlight, heat, or solar energy.
  • Removal, handling, storage, transportation, relocation, or reinstallation that causes or contributes to damage.
  • Use of the product outside its intended or recommended application.
  • Other conditions caused by installation, site conditions, third parties, or factors outside the covered product itself.

REPLACEMENT PRODUCT

REPLACEMENT PRODUCT

Approved warranty remedies may involve partial replacement, a reasonably comparable replacement product, or Warranty Credit, subject to the applicable warranty terms.

PARTIAL REPLACEMENT

An approved warranty claim may result in replacement of only the qualifying affected product. Unaffected portions are not automatically included.

APPEARANCE MAY VARY

New replacement material may differ in color, shade, sheen, texture, or overall appearance from existing installed product that has experienced normal aging, use, wear, weather, UV exposure, cleaning, maintenance, or other environmental conditions.

EXACT MATCH IS NOT GUARANTEED

If the original product, model, design, color, component, or configuration is unavailable or discontinued, 123COURTS may provide a reasonably comparable replacement product or an applicable Warranty Credit.

THE WARRANTY DOES NOT RESTART

A warranty replacement does not restart, renew, or extend the original 10-year warranty period. Replacement product is covered only for the remainder of the original warranty term.

WARRANTY CLAIMS

HOW TO FILE A WARRANTY CLAIM

Your claim path depends on where the covered product was originally purchased.

PATH 01

PURCHASED DIRECTLY FROM 123COURTS

If the covered product was purchased directly from 123COURTS, the Original End Consumer should submit the warranty claim directly to 123COURTS.

PATH 02

PURCHASED THROUGH A DEALER OR CONTRACTOR

The Original End Consumer should submit the warranty claim to the original selling dealer or contractor. The dealer or contractor will coordinate the claim with 123COURTS.

If the original selling dealer or contractor is no longer in business, cannot reasonably be located, or is otherwise unavailable to administer the claim, the Original End Consumer may contact 123COURTS for assistance. Additional documentation may be required.

WHAT YOU'LL NEED

  • Proof of purchase.
  • 123COURTS order or invoice number, when applicable.
  • Product identification.
  • Quantity of affected product.
  • Delivery date.
  • Installation date.
  • Description of the claimed condition.
  • Installation information.

  • At least three clear photographs from different angles showing the claimed condition.

  • Any additional information, documentation, photographs, measurements, video, or samples reasonably requested by 123COURTS.
Important: Submission of a claim does not constitute approval of warranty coverage.

1. 10-YEAR LIMITED PRODUCT WARRANTY

123COURTS provides a 10-Year Limited Product Warranty on covered 123COURTS modular sports flooring products, subject to the terms, conditions, limitations, exclusions, and Warranty Value Schedule contained in this Limited Product Warranty.

This warranty covers qualifying defects or covered conditions attributable to the covered product itself. It is a product-only warranty and does not constitute an installation, workmanship, site-condition, base, subsurface, drainage, engineering, or contractor warranty.

The warranty period begins on the original purchase date of the covered product by the Original End Consumer.

2. ORIGINAL END CONSUMER & TRANSFERABILITY

This Limited Product Warranty applies exclusively to the Original End Consumer of new covered 123COURTS product.

For products purchased directly from 123COURTS, the Original End Consumer is the person or entity that originally purchased the covered product from 123COURTS for end use. For products purchased through an authorized dealer or contractor, the Original End Consumer is the person or entity that originally purchased the covered product from that dealer or contractor for end use.

The sale, transfer, or change of ownership of the property, court, facility, business, or location where the product is installed does not transfer this warranty to any subsequent owner, purchaser, occupant, tenant, or other third party.

3. KEEP YOUR PROOF OF PURCHASE

Proof of purchase is required to establish warranty eligibility.

The Original End Consumer should retain the original invoice, receipt, sales contract, order confirmation, or other acceptable documentation showing the original purchase of the covered 123COURTS product. For products purchased through a dealer or contractor, proof of purchase from the original selling dealer or contractor must be retained.

If sufficient proof of purchase cannot be provided, 123COURTS may be unable to verify the purchase date, covered product, Original End Consumer, or other information necessary to establish warranty eligibility.

Product possession, photographs, or installation at a particular property, standing alone, do not establish proof of original purchase.

4. WHAT THIS WARRANTY COVERS

Subject to all terms of this warranty, 123COURTS warrants covered products against qualifying defects in material or manufacturing and other covered product conditions determined by 123COURTS to be attributable to the covered product itself during the applicable warranty period.

Coverage applies only to the qualifying affected covered product. A condition affecting one portion of a court or installation does not, by itself, establish that unaffected portions are defective or covered.

123COURTS may require photographs, documentation, samples, installation information, site information, or other information reasonably necessary to determine whether a claimed condition is attributable to the covered product.

6. WARRANTY BASE

For covered products purchased directly from 123COURTS, the Warranty Base is the net product purchase price actually paid to 123COURTS for the qualifying affected covered product, after applicable product discounts.

Taxes, shipping, freight, delivery charges, installation, labor, services, and all other non-product charges are excluded from the Warranty Base.

Products purchased through a dealer or contractor are administered under the applicable 123COURTS dealer/contractor warranty process. Dealer pricing, discounts, margins, markups, resale pricing, and other confidential commercial terms do not increase the warranty obligation of 123COURTS.

7. PRODUCT-ONLY WARRANTY

This Limited Product Warranty covers eligible product value only. It does not cover shipping; freight; delivery charges; taxes; installation; labor; removal; disassembly; disposal; site preparation; base or subsurface work; equipment; reinstallation; contractor charges; loss of use; or any other additional costs, charges, or services associated with a warranty claim, replacement, or Warranty Credit.

These costs remain the responsibility of the customer even when 123COURTS approves a warranty claim.

8. WARRANTY REMEDIES

If 123COURTS determines that a claim qualifies for coverage, 123COURTS may, subject to the applicable Warranty Value, provide one of the following remedies:

A. Replacement of Qualifying Affected Product. Replacement of all or part of the covered product determined to qualify under this warranty.

B. Reasonably Comparable Replacement Product. If the original product, color, design, component, or configuration is no longer available, 123COURTS may provide a reasonably comparable replacement product.

C. Warranty Credit. 123COURTS may issue a Warranty Credit toward the purchase of eligible replacement product.

The appropriate remedy will be determined by 123COURTS based on the qualifying affected product, product availability, age, applicable Warranty Value, nature of the covered condition, and circumstances of the claim.

9. WARRANTY CREDIT

A Warranty Credit is a non-cash warranty remedy. It has no cash value; is not redeemable for cash; is not a cash refund; does not reimburse previous payments; may be applied only toward eligible replacement product as authorized by 123COURTS; and is subject to the applicable Warranty Value and all other terms of this warranty.

If the cost of replacement product selected by the customer exceeds the authorized Warranty Credit, the customer is responsible for the remaining balance and all additional charges.

When authorized by 123COURTS, a customer may apply a Warranty Credit toward a larger eligible replacement purchase. Doing so does not establish that unaffected portions of the original installation were defective.

Any discretionary courtesy, accommodation, or goodwill discount offered by 123COURTS for a condition not covered by this warranty is separate from a Warranty Credit and does not establish warranty coverage, precedent, or a continuing contractual right.

10. COLOR FADING & APPEARANCE CHANGES

Covered products may experience normal changes in color, shade, sheen, or appearance over time as a result of ordinary aging, use, UV exposure, weather, environmental conditions, cleaning, and maintenance. Normal or gradual appearance changes are not, by themselves, considered a product defect.

Abnormal or excessive fading that may be attributable to the covered product may be submitted to 123COURTS for warranty review.

123COURTS may evaluate product age; extent and pattern of reported fading; installation and site conditions; environmental exposure; maintenance history; surrounding structures and reflective surfaces; and other information relevant to determining the cause of the condition.

If 123COURTS determines that abnormal or excessive fading constitutes a covered product condition, the approved remedy will be subject to the applicable Warranty Value Schedule and all other terms, limitations, and exclusions of this Limited Product Warranty.

11. REFLECTED SUNLIGHT & CONCENTRATED HEAT

Fading, discoloration, warping, deformation, distortion, melting, surface damage, or other deterioration caused or contributed to by reflected or concentrated sunlight, heat, or solar energy is not covered by this Limited Product Warranty.

This includes conditions resulting from sunlight or heat reflected, redirected, or concentrated by windows; glass doors; mirrors; reflective building materials; metal surfaces; architectural features; vehicles; or other reflective surfaces or objects.

Customers are responsible for evaluating surrounding site conditions and potential sources of reflected or concentrated sunlight or heat before and after installation.

Localized fading, discoloration, deformation, melting, or other deterioration in an area exposed to reflected or concentrated sunlight or heat does not, by itself, constitute a covered product defect.

12. REPLACEMENT PRODUCT — COLOR & APPEARANCE VARIATION

When an approved warranty claim results in replacement of only a portion of an installed court, the replacement product may differ in color, shade, sheen, texture, or overall appearance from the existing installed product.

Replacement material is new, while existing product may have experienced normal aging, use, wear, weather exposure, UV exposure, cleaning, maintenance, or other environmental conditions. Manufacturing variations may also occur between production runs.

Accordingly, an exact color or visual match between replacement product and existing installed product is not guaranteed.

Differences in appearance between new replacement product and existing product do not, by themselves, constitute a product defect and do not entitle the customer to replacement of unaffected portions of the court.

13. PRODUCT & COLOR AVAILABILITY

123COURTS does not guarantee that a particular product, model, design, color, component, configuration, or other product characteristic will remain available throughout the full warranty period.

Products, components, colors, specifications, and product lines may change or be discontinued.

When an exact replacement is unavailable, 123COURTS may provide a reasonably comparable replacement product or an applicable Warranty Credit as the authorized warranty remedy.

14. WARRANTY PERIOD FOLLOWING REPLACEMENT

Any replacement product supplied as a remedy under this Limited Product Warranty remains subject to the original warranty period applicable to the product for which the approved claim was made.

A warranty replacement does not restart, renew, or extend the original 10-year warranty period. Replacement product is covered only for the remainder of the original warranty term.

The issuance of a Warranty Credit likewise does not restart, renew, or extend the warranty period applicable to the original product.

A separate new product purchase made in connection with or in addition to a Warranty Credit will be subject to the warranty terms applicable to that separate new purchase, as documented by 123COURTS.

15. APPROVED INSTALLATION SURFACES

Covered 123COURTS modular sports flooring must be installed only over a surface approved by 123COURTS for the applicable product and application and in accordance with applicable 123COURTS installation requirements.

An approved surface must also be properly prepared, stable, level, suitable for the intended application, and maintained in a condition appropriate for installation and continued use of the covered product.

Approval of a surface type does not constitute approval by 123COURTS of the condition, construction, drainage, grade, preparation, structural suitability, or other characteristics of a particular project site.

The applicable 123COURTS installation and technical documentation determines approved surface requirements for the applicable product and application.

16. INSTALLATION, BASE & SITE CONDITIONS

123COURTS sells modular sports flooring products and court kits. Unless expressly agreed otherwise in a separate written agreement, 123COURTS does not provide installation services.

The customer and/or the customer’s independent installer are responsible for determining and maintaining appropriate project dimensions; approved supporting surface; base and subsurface conditions; grade; drainage; clearances; site preparation; installation methods; applicable permits; applicable codes; and project safety requirements.

Technical information or installation guidance provided by 123COURTS does not constitute engineering, architectural services, contractor supervision, site inspection, certification, approval, or acceptance of the customer’s installation or site conditions.

Damage or failure resulting from an unsuitable supporting surface, improper installation, improper site preparation, or other site-related conditions is not covered by this product warranty.

17. DRAINAGE, STANDING WATER & SITE MOVEMENT

Damage, movement, deformation, deterioration, or other product conditions caused or contributed to by inadequate drainage; standing water; flooding; erosion; settlement; movement or deterioration of the supporting surface; improper grade; or other site-related conditions are not covered by this Limited Product Warranty.

The customer and/or installer is responsible for determining that site and drainage conditions are appropriate for the intended installation.

18. PRODUCT MODIFICATIONS

Cutting, drilling, fastening, altering, modifying, repairing, or otherwise changing the covered product in a manner not authorized by applicable 123COURTS installation requirements may void warranty coverage for the affected product.

Proper field cuts or other modifications expressly permitted by applicable 123COURTS installation instructions do not, by themselves, void this Limited Product Warranty.

Damage caused or contributed to by unauthorized modification, repair, cutting, fastening, alteration, or other changes to the product is not covered.

19. REMOVAL, RELOCATION & REINSTALLATION

Removal, relocation, or reinstallation of covered product does not transfer this warranty to another person and does not restart, renew, or extend the original warranty period.

Damage or other product conditions caused or contributed to by removal, handling, storage, transportation, relocation, or reinstallation are not covered.

Any reinstallation must comply with the then-applicable 123COURTS installation requirements, including approved-surface requirements, for warranty coverage to remain in effect.

Installation or reinstallation over a non-approved surface is subject to the Approved Installation Surfaces provision of this warranty.

20. WHAT THIS WARRANTY DOES NOT COVER

Without limiting other exclusions contained in this warranty, coverage does not apply to damage, deterioration, failure, appearance changes, or other conditions caused or contributed to by:

  • improper installation
  • installation over any surface not approved by 123COURTS for the applicable product or application
  • improper repair or unauthorized product modification
  • improper cleaning or maintenance
  • failure to follow applicable product or installation requirements
  • uneven, unstable, unsuitable, improperly prepared, or deteriorated supporting surfaces, bases, or subsurfaces
  • inadequate drainage, standing water, flooding, erosion, settlement, or site movement
  • improper site conditions
  • abuse, misuse, neglect, vandalism, or intentional damage
  • cutting, burning, fire, or similar physical damage except for authorized field modifications performed in accordance with applicable installation requirements
  • inappropriate footwear, equipment, vehicles, machinery, loads, or uses
  • chemicals, herbicides, pesticides, solvents, corrosive materials, or other harmful substances
  • abnormal environmental conditions
  • force majeure events or circumstances beyond the reasonable control of 123COURTS
  • normal wear, abrasion, scratching, cosmetic deterioration, or aging resulting from ordinary use
  • normal or gradual color or appearance changes
  • fading, discoloration, warping, deformation, melting, or deterioration caused or contributed to by reflected or concentrated sunlight, heat, or solar energy
  • removal, handling, storage, transportation, relocation, or reinstallation that causes or contributes to damage
  • use of the product outside its intended or recommended application
  • other conditions caused by installation, site conditions, third parties, or factors outside the covered product itself

21. NORMAL WEAR & AGING

Modular sports flooring is subject to normal wear and aging during its service life.

Normal wear, abrasion, cosmetic changes, minor appearance variation, and ordinary deterioration resulting from use are not, by themselves, manufacturing defects.

Warranty coverage is intended for qualifying covered product conditions and not the ordinary effects of use, exposure, and aging.

22. HOW TO SUBMIT A WARRANTY CLAIM — DIRECT PURCHASES

If the covered product was purchased directly from 123COURTS, the Original End Consumer should submit the warranty claim directly to 123COURTS.

A claim should include, as applicable: proof of purchase; 123COURTS order or invoice number; product identification; quantity of affected product; delivery date; installation date; description of the claimed condition; installation information; installer information, including whether installation was DIY or performed by a contractor; at least three clear photographs from different angles showing the claimed condition; photographs showing the product in its installed environment; and any additional information, documentation, photographs, measurements, video, or samples reasonably requested by 123COURTS.

Submission of a claim does not constitute approval of warranty coverage.

23. PURCHASES THROUGH A DEALER OR CONTRACTOR

If covered 123COURTS product was originally purchased through a dealer or contractor, the Original End Consumer should submit the warranty claim to the original selling dealer or contractor.

The dealer or contractor will coordinate the claim with 123COURTS, including applicable product verification, supporting documentation, claim review, and any approved warranty remedy.

Proof of original purchase from the selling dealer or contractor is required.

If the original selling dealer or contractor is no longer in business, cannot reasonably be located, or is otherwise unavailable to administer the claim, the Original End Consumer may contact 123COURTS for assistance. Additional documentation may be required to establish warranty eligibility and the original transaction.

Dealer/contractor pricing, margins, discounts, and other confidential commercial terms are not part of the customer-facing warranty determination.

24. CLAIM REVIEW & DETERMINATION

123COURTS will review the information provided and determine whether the claimed condition qualifies for coverage under this Limited Product Warranty.

123COURTS may request additional photographs; video; documentation; installation information; site information; product information; samples; measurements; maintenance information; or other information reasonably necessary to evaluate the claim.

123COURTS may require photographs, project records, installation records, or other reasonable evidence sufficient to verify the type and condition of the surface over which the covered product was installed.

123COURTS may consider the product’s age, installation, approved-surface compliance, site conditions, environmental exposure, maintenance, use, condition pattern, and other relevant circumstances when evaluating a claim.

Failure to provide information reasonably necessary to establish warranty eligibility or evaluate the claimed condition may prevent 123COURTS from completing the warranty review.

The existence of a reported condition, submission of photographs, or submission of a claim does not by itself establish that a product defect exists or that the condition is covered.

25. MAXIMUM WARRANTY RESPONSIBILITY

123COURTS’ warranty responsibility is limited to the applicable Warranty Value of the qualifying affected covered product, calculated in accordance with this Limited Product Warranty.

Warranty remedies do not include taxes, shipping, freight, delivery, installation, labor, removal, disassembly, disposal, site preparation, equipment, reinstallation, or any other additional cost, charge, or service.

For direct purchases, the applicable Warranty Base cannot exceed the eligible net product purchase price actually paid to 123COURTS for the qualifying affected covered product.

Purchases through dealers or contractors are subject to the applicable dealer/contractor warranty administration terms between 123COURTS and the selling dealer or contractor.

26. SHIPPING DAMAGE & DELIVERY DISCREPANCIES

This Limited Product Warranty is not the process for reporting damage, shortages, incorrect merchandise, or other discrepancies associated with the original delivery of an order.

Original shipment and delivery issues are governed by the applicable 123COURTS Shipping & Delivery Policy and its inspection, notification, documentation, and claim requirements.

Shipping or freight associated with a later warranty replacement is not covered by this Limited Product Warranty and remains the customer’s responsibility.

27. RELATIONSHIP TO OTHER 123COURTS TERMS

This Limited Product Warranty should be read together with the applicable 123COURTS Terms of Use; 123COURTS Shipping & Delivery Policy; 123COURTS Return & Refund Policy; applicable 123COURTS installation and technical documentation; order documentation; and other terms applicable to the customer’s transaction.

The Return & Refund Policy governs cancellation, return, refund, and final-sale matters. The Shipping & Delivery Policy governs applicable original shipment, receiving, shortage, damage, and delivery matters. This Limited Product Warranty governs qualifying product warranty claims during the applicable warranty period.

A warranty claim does not independently create a right to cancel an order, return final-sale merchandise, or obtain a cash refund.

28. RIGHTS UNDER APPLICABLE LAW

This Limited Product Warranty defines the express limited product warranty provided by 123COURTS.

Nothing in this warranty is intended to exclude, restrict, or modify rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable law.

To the extent a provision of this Limited Product Warranty conflicts with a non-waivable requirement of applicable law, the applicable legal requirement will control to the extent of that conflict.
